Democrats Demagogue on Supreme Court – Forget their Own History of Judicial Obstruction

Almost immediately following the announcement that Justice Antonin Scalia had passed away, Democrats began drooling over the possibility that President Obama might get an opportunity to name one more liberal to the court before walking away from the White House. In response, every conservative and their mother (except for sad ol’ Jeb Bush) stood up to promise the Democrats that they’d have a fight on their hands if Obama tried to ram a nominee through. GOP leaders from Senator Ted Cruz (R-TX) to Senator Mitch McConnell (R-KY) have promised to stand against Obama’s eventual attempt at stacking the Supreme Court deck with liberals.

Now, Congressional Democrats are trying to demagogue and vilify their Republican colleagues as intransigent and unpatriotic for their decision to stop Obama from appointing a 3rd justice to the court. However, such rhetorical nonsense is uncalled for, considering the fact that this generation of Democrats has turned obstructing judicial nominees into an art form. Just in case you’re unsure of what I’m talking about, let’s travel back to the Reagan administration and the President’s attempt at appointing one of the most brilliant legal minds of the last century, Judge Robert Bork, to the court.

President Reagan nominated one of the most talented jurists our nation has ever seen, only to watch a good man be systematically destroyed by the immoral and unjust attacks from liberals led by none other than Delaware Senator Joe Biden.

In more recent days, Senator “Chuck” Charles Schumer (D-NY) has been whining to anyone who will listen that the GOP is obstructing President Obama by refusing to allow him to appoint a justice to replace Scalia. But just a few years ago, Senator Schumer was all about Senate obstruction, when he told President Bush and the GOP that the Democrats would not be allowing Bush to appoint another justice – even though there were still 19 months left in the Bush presidency!

“I will do everything in my power to prevent one more ideological ally from joining (Justices John) Roberts and (Samuel) Alito,” and recommended the Senate, “should not confirm any Bush nominee to the Supreme Court except in extraordinary circumstances.” “The Supreme Court is dangerously out of balance,” Schumer told the American Constitution Society on July 27, 2007. “With respect to the Supreme Court at least, I will recommend to my colleagues that we should not confirm any Bush nominee to the Supreme Court except in extraordinary circumstances.”

The Democrats’ willful hypocrisy is stunning. The disgusting disregard they have for the American people continues to shine through, yet they wonder why the GOP continues to dominate elections across the nation.

Despite the fact that Democrats would undoubtedly stand firm against a conservative president — and despite the fact that the confirmation of Kennedy rather than Bork represented one of the most consequential triumphs of Senate obstructionism in our lifetimes — expect Democrats and their activist allies to keep hammering home the notion that the Democrats would be totally fair and reasonable if the tables were turned.

Here’s hoping that the GOP stands strong against the pressures they’re sure to face in the coming months. We cannot allow President Obama to appoint another Supreme Court justice.
