The British spy agency GCHQ were sought by the Obama administration to obtain transcripts of conversations that involved Trump.
“Three intelligence sources have informed Fox News that President Obama went outside the chain of command,” Napolitano said. “He didn’t use the NSA. He didn’t use the CIA. He didn’t use the FBI, and he didn’t use Department of Justice. He used GCHQ.”
“What the heck is GCHQ?” Napolitano asked. “That’s the initials for the British spying agency. They have 24/7 access to the NSA database.”
“So by simply having two people go to them saying, ‘President Obama needs transcripts of conversations involving candidate Trump, conversations involving president-elect Trump,’ he’s able to get it, and there’s no American fingerprints on this,” Napolitano added.
Napolitano went on to state that the man who actually gave the surveillance order “resigned three days after Trump was inaugurated,” but failed to name the man.
Last week, Judge Napolitano said that it was not illegal for Obama to listen in on Trump’s call. However, he then claimed that it was “immoral and profoundly unconstitutional and utterly wrong, but it’ lawful because Congress has said it is lawful.”
Nothing could be further from the truth. Furthermore, seeking out an agency from another country to spy on an American citizen without probable cause and without a warrant is a criminal act by the White House in clear violation of the Fourth Amendment.
On Monday, the Department of Justice requested time to present its evidence of Trump’s allegations against Obama’s surveillance of him and his advisers to the House Intelligence Committee. March 20 is the deadline for the DOJ to present that evidence to the committee.
